TERMS AND CONDITIONS

These Terms and Conditions (“Terms“) of the Lucky Referrer Contest (“Contest“) apply between TaxSavers and you. By clicking on the ‘I accept’ option, you agree to be unconditionally bound by the terms for participating in the Contest.

1. The Contest opens on February 15, 2010. TaxSavers, in its sole discretion, withdraw the Contest at any time without any notice.

1. The Contest is open only for persons resident in India.

1. In order to participate, you must register with TaxSavers by logging on to www.taxsavers.in, navigating to the Contest Page, and referring one or more of your contacts (“Friend/s“) to TaxSavers by providing the details mentioned below. You may log on from any computer in India.

1. In the Contest Page, You must fill in details in all the fields marked as “mandatory” or “*“, including your name and mobile number, the name/s and mobile number/s of your friend/s. You may refer any number of friend/s, and there is no upper limit on the references and you can log on any time to increase the number of friends/s, with their name at any time. Once you provide all requisite details in full, the friends you have referred will receive an automated electronic mail from you and you will receive a short message service (“SMS”) from TaxSavers confirming your registration for participation in the contest. This registration is valid till withdrawal of the contest by TaxSavers.

1. TaxSavers shall keep confidential all information you disclose during the registration and referral process; the terms of TaxSavers privacy policy shall apply to all such information.

1. In order for you to be eligible to win a prize for a particular lucky draw, at least one friend/s you have referred must register on TaxSaver.in before the closing date for that particular lucky draw. If none of your friend/s registers on TaxSavers.in before the closing date for that particular lucky draw, you will not be eligible to win.

1. The winner of the contest is chosen by a lucky draw conducted by TaxSavers from a list of names/numbers of all the members (friend/s or references of all the contestants) who registered on TaxSavers before closing date for each lucky draw. The lucky draw is conducted at regular intervals, using a computer, at the discretion of TaxSavers. As a contestant, you will not have the right to insist the draw be held on particular date or time. TaxSavers may increase or decrease the number of winners at its sole discretion at any time without any notice.

If it is found that the name/number of caller selected in the draw have been referred by more than one contestant, i.e. you and someone else, TaxSavers may, in its sole discretion, declare both you and such other person/s as winners, or conduct another draw to pick one as the winner, or require all such contestants to share the value of the prize or declare the person who referred the caller selected first as the winner.

1. Details of the prizes to be given to winners of the contest in each lucky draw shall be available on the contest page of www.taxsavers.in. TaxSavers may alter the prizes for lucky draw at its sole discretion.

10. Prizes are non-transferable, non-negotiable, subject to availability and there will be no cash alternative.

11. The winners will be notified by an e-mail or through a call or SMS on the mobile number given for participation or by declaration on the contest Page at www.taxsavers.in. The winners must give their photo identity and residential proof within 7 days of notification/declaration. The winner also should issue a D.D in favor of TaxSavers towards tax applicable on the value of prizes, if the value of price exceeds Rs. 5000, which can enable TaxSavers to deposit the same with the government. In case the winner failed to produce identity proof, residential proof documents and D.D. for the tax amount within the stipulated period the prize of the winner automatically stands forfeited and the winner shall have no right to claim the prize thereafter.

12. Mode of delivery of prizes will be at the sole discretion of TaxSavers. Cost of traveling and other incidental expenses to visit the nearest TaxSavers branch location shall be borne by the winners in case TaxSavers request the winner to collect the prizes. In case TaxSavers opt for home delivery, cost of packing, delivery, Shipping, courier, postage, and other incidental charges, if any, and risk of prizes shall be borne by the winners. In any case, the winner will not be eligible for the prize, if the winner failed to submit residence proof, identity proof and D.D. for the tax amount (as mentioned in clause 12 above) within the stipulated period.

13. TaxSavers is not responsible for and shall not be liable for any taxes applicable on the prizes or on the contest, late, lost, misdirected, or unsuccessful efforts (including non-delivery due to non-payment of delivery, shipping or other charges) by any dealer/retailer, shipping/courier agents or postal authorities to deliver the prizes to the winner. Further the prize also stands forfeited if (a) the winner not paid D.D. for applicable taxes (b) the winner not paid Cost of Shipping or courier charges to receive the prize, (c) prizes lost in transit, misdirected or unsuccessful efforts by any shipping/courier agents or postal authorities to deliver the prizes to the winner.

14. TaxSavers shall not be liable for: a) any taxes applicable on the prizes or on the contest b) any SMS delivery failures; c) any lost, late or misdirected computer transmission or network, electronic failures of any kind or any failure to receive/ retrieve entries owing to transmission failures or due to any technical reasons; d) other conditions beyond its reasonable control and e) any damage or loss (whether direct, indirect, or consequential loss arising from any personal injury or death, or loss of damage or property you suffer by participating in the contest TaxSavers liability to you for direct damages shall be limited only to the value of individual prize(after deducting taxes if applicable) you have / may have won in the contest during any particular lucky draw.

15. TaxSavers shall not be liable for: a) any SMS delivery failures; b) any lost, late or misdirected computer transmission or network, electronic failures of any kind or any failure to receive/ retrieve entries owing to transmission failures or due to any technical reasons; c) other conditions beyond its reasonable control and d) any damage or loss (whether direct, indirect, or consequential loss arising from any personal injury or death, or loss of damage or property you suffer by participating in the contest TaxSavers liability to You for direct damages shall be limited only to the value of individual prize You have / may have won in the contest during any particular lucky draw.

16. TaxSavers reserves the right to delete / alter / modify the content and or / the terms and conditions at its own discretion and without any prior notice and / or assigning any reason. Therefore, the participant is advised to regularly check for any amendment(s) or update(s) to the terms and conditions.

17. The Terms shall be governed by the laws of India. Any disputes arising out of or in connection with the contest or terms shall be decided by arbitration conducted in English at New Delhi by a sole arbitrator who will be the Chief Executive Officer of TaxSavers. Subject to the above, the parties shall be subject to the exclusive jurisdiction of the courts in New Delhi.
